Distance Sales Contract

ARTICLE 1 – PARTIES

1.2 – BUYER
The person who becomes a member of the www.becka.com.tr shopping site as a customer. The address and contact information used when registering is taken as basis.

ARTICLE 2 – SUBJECT
The subject of this contract is the determination of the rights and obligations of the parties in accordance with the provisions of the Law No. 6502 on the Protection of Consumers and the Regulation on the Application Principles and Procedures of Distance Contracts, regarding the sale and delivery of the product, the characteristics and sales price of which are specified below, which the BUYER ordered electronically from the SELLER's website www.becka.com.tr.

ARTICLE 3 – PRODUCT SUBJECT TO THE CONTRACT
The type, quantity, brand/model, colour, number, sales price and payment method of the Goods/Product/Service consist of the information at the time the order is finalised.

ARTICLE 4 – GENERAL PROVISIONS
4.1) The BUYER declares that he/she has read and approved the basic characteristics of the contractual product, the sales price including all taxes, the payment method and delivery information on the www .becka .com .tr website.

4.2) The product subject to the contract is delivered to the BUYER or the person/organization at the address indicated by the BUYER within the specified period, depending on the distance of the BUYER's place of residence.

4.3) SELLER cannot be held responsible if the cargo company cannot deliver the product to the BUYER.

4.4) The SELLER is responsible for the delivery of the contractual product in a sound, complete manner, in accordance with the specified qualifications and with warranty documents and user manuals, if any.

4.5) SELLER may supply a different product of equal quality and price based on a justified reason.

4.6) In order for the product to be delivered to the SELLER, the price must be paid and the signed copy of the contract must reach the SELLER. If payment is not made, the product will not be delivered.

4.7) BUYER accepts responsibility for the accuracy of credit card information and its use.

4.8) If delivery is not made due to force majeure, the BUYER has the right to cancel the order, replace the product or postpone delivery.

4.9) Points given by the SELLER through a campaign are valid for one purchase only. Points will not be refunded for returned products.

ARTICLE 5 – RIGHT OF WITHDRAWAL
5.1) The BUYER has the right to withdraw without giving any reason within 14 days from the delivery of the contracted product.

5.2) In order to exercise the right of withdrawal, the SELLER must be notified by e-mail or registered mail within 14 days. The product must be unused and in its original packaging.

5.3) In the return process, the product box, packaging and accessories, if any, must be returned complete and undamaged, along with the product invoice and return form.

ARTICLE 6 – PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED

  • Disposable products
  • Copyable software and programs
  • Products that spoil quickly or are likely to expire

ARTICLE 7 – DEBTOR’S DEFAULT
BUYER agrees to pay the SELLER's damages in the event of default. BUYER does not claim any damages in case of defaults caused by SELLER's fault.

ARTICLE 8 – COMPETENT COURT
Istanbul (Anatolia) Consumer Arbitration Committee or Consumer Courts are authorized to resolve disputes arising from this contract. In places where there is no Consumer Court, the Civil Court of First Instance is authorized.

This agreement is subject to Turkish Law.
